Welcome to Kasapp! These Terms and Conditions ("Terms") govern your access to and use of the Kasapp mobile application and its related services (collectively, the "Service"). Please read these Terms carefully before using our Service.
By creating an account or by accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.
1. Description of the Service
Kasapp is a platform designed to connect individuals in the real estate market. The Service allows users ("Users") to:
Publish listings for properties for sale or rent ("Listings").
Search and filter for properties based on various criteria.
Save favorite properties and searches.
Schedule visits or express interest in properties, connecting potential buyers/renters with property listers (e.g., owners or real estate agents).
2. User Accounts
To access most features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process. You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
3. User-Generated Content
Your Content: Users are solely responsible for the content they post, upload, or otherwise make available on the Service, including photos, descriptions, prices, and any other information ("User Content"). You represent and warrant that you own or have the necessary rights and permissions to all of your User Content and that its posting does not violate any third-party rights (including copyright, trademark, or privacy rights).
License Grant to Kasapp: You retain all ownership rights to your User Content. However, by submitting User Content to the Service, you grant Kasapp a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, display, distribute, and prepare derivative works of your User Content in connection with providing and promoting the Service.
4. Lead Generation and Information Sharing
You acknowledge and agree that a primary function of the Service is to facilitate connections between parties in the real estate market.
By expressing interest in a property (for example, by using the "Schedule a Visit" feature or another similar call to action), you explicitly consent to Kasapp sharing your relevant contact information (such as your name, email address, and phone number) and inquiry details with the real estate agent, owner, or lister associated with that property. This sharing of information is essential for the purpose of facilitating communication and potential real estate transactions.
5. Acceptable Use and Prohibited Conduct
As a condition of your use of the Service, you agree not to:
Post any false, misleading, fraudulent, or inaccurate information.
Infringe upon any third-party's intellectual property rights.
Harass, threaten, or defame any other User.
Use the Service for any illegal or unauthorized purpose.
Scrape, spider, or use other automated data-gathering methods to access the Service.
Post content that is obscene, pornographic, or offensive.
Kasapp reserves the right to remove any content or suspend/terminate any account that violates these rules, without prior notice.
6. Service Fees
The use of the Kasapp Service is currently free for all users. There are no fees for listing properties, searching for properties, or connecting with other users. We reserve the right to introduce fees or subscription models in the future, and we will provide you with
advance notice of any such changes.
7. Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
No Guarantee of Accuracy: Kasapp does not verify, endorse, or guarantee the accuracy, completeness, or reliability of any User Content, including property listings, descriptions, or prices. All Users are encouraged to conduct their own due diligence and verification.
No Involvement in Transactions: Kasapp is a neutral platform. We are not a real estate agency, broker, or lender. We are not involved in, and shall not be held responsible for, any communication, negotiation, or transaction that occurs between Users. All agreements are solely between the buyer/renter and the seller/lister.
No Legal or Financial Advice: The content and features provided on Kasapp are for informational purposes only and do not constitute legal, financial, or real estate advice. You should consult with a qualified professional for such advice.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KASAPP, ITS AFFILIATES, DIRECTORS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
(A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE;
(B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE;
(C) ANY CONTENT OBTAINED FROM THE SERVICE; OR
(D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
9. Termination
We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws of the Bolivarian Republic of Venezuela, without regard to its conflict of law provisions.
11. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
